Terms of Service

Effective when this policy is published.

These Terms of Service govern fixed-fee consulting engagements purchased from Acute Project Management Consulting LLC, doing business as Acute PMC. By purchasing an engagement, you agree to these Terms and the posted Refund and Cancellation Policy.

Services

Acute PMC offers the Project Clarity Session and Project Rescue Intensive. Each fixed-fee engagement covers one clearly identified project and includes only the scope described on the applicable public service page and purchase confirmation. Additional work requires a separate written agreement.

Fees and payment

Fees are due at purchase through the verified Stripe checkout once enabled. The Project Clarity Session is $650 for 60 minutes. The Project Rescue Intensive is $1,250 for 90 minutes. Payment does not create an open-ended retainer or obligation to perform work outside the purchased scope.

Intake, scheduling, and participation

Payment occurs first, followed by intake and booking. The buyer must book within 14 calendar days after payment. Sessions require at least 72 hours of lead time and are presented in Mountain Time unless the booking provider clearly converts them. Intake and requested materials are due at least 48 hours before the session. If no mutually acceptable appointment is available within the 14-day booking period, the client may request a full refund. The applicable brief is delivered by email within two business days after the session. One consolidated clarification request may be submitted within five business days after delivery and is limited to explanation or correction of the purchased brief.

Client responsibilities

You remain responsible for project decisions, approvals, execution, stakeholder communication, legal compliance, security, and results. You must provide accurate information, ensure participants are authorized to discuss the project, and submit only material you have authority to disclose. Client lateness does not extend the scheduled session.

Nature of guidance

Acute PMC provides project and program consulting judgment based on the information available during the engagement. Guidance is not legal, tax, accounting, investment, cybersecurity, engineering, medical, or other regulated professional advice. Acute PMC does not guarantee a particular project, financial, organizational, operational, approval, schedule, cost, or recovery outcome.

Confidentiality and sensitive information

Acute PMC will use nonpublic client information reasonably necessary for service delivery only for that purpose and will limit access to necessary approved providers or personnel. This commitment does not apply to information that becomes public without breach, was already lawfully known, is lawfully received from another source, is independently developed, or must be disclosed by law. Do not submit information you lack authority to disclose, passwords or authentication secrets, complete payment-card information, classified information, or PHI or similarly regulated sensitive information unless Acute PMC separately approves an appropriate written handling arrangement. Unusually sensitive engagements may require a separate written agreement.

Deliverables and use

The client retains ownership of client-submitted material. The purchasing client may use and distribute the final client-specific Project Clarity Brief or Recovery Brief internally within its organization for legitimate business purposes. Acute PMC retains ownership of its pre-existing methods, frameworks, templates, diagnostic structures, question sets, general know-how, and reusable non-client-specific intellectual property. Neither party may publicly publish the other party’s confidential material without appropriate written permission.

Third-party services and project materials

Payment, intake, scheduling, email, hosting, or approved file handling may be provided by third-party services, and their terms and privacy practices apply to their systems. Acute PMC is not a document-storage or records-management service. Clients are responsible for retaining their own source materials and delivered briefs. Acute PMC may retain submitted project files for up to 30 days after delivery of the applicable brief. After 30 days, those files may be permanently deleted and may not be recoverable. Clients should not expect Acute PMC to retain or reconstruct submitted project data after that period. Provider backups may persist according to provider capabilities and documented deletion cycles.

Refunds and cancellations

Refunds, rescheduling, cancellations, no-shows, client lateness, and an Acute PMC cancellation are governed by the Refund and Cancellation Policy posted on this website. Once a working session begins, the engagement is considered delivered and non-refundable except when Acute PMC fails to provide the purchased service.

Limitation and allocation of responsibility

To the extent permitted by law, services and deliverables are provided without a warranty of a particular result. Acute PMC’s aggregate liability arising from an engagement will not exceed the fees actually paid for that engagement. Acute PMC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost profits, lost revenue, or lost opportunity. The client is responsible for claims arising from material it was not authorized to provide or instructions that violate law or third-party rights. Before beginning a formal dispute, the parties will attempt good-faith informal resolution. These Terms and related disputes are governed by Idaho law, without regard to conflict-of-law rules. Nothing in this section limits liability that cannot lawfully be limited. The Refund and Cancellation Policy controls refunds and scheduling.

Changes

Acute PMC may update these Terms for future purchases. The version in effect when an engagement is purchased governs that engagement unless the parties agree otherwise in writing.
