TERMS OF SERVICE
Effective September 30, 2026.
These Terms of Service govern professional services purchased from Acute Project Management Consulting LLC, doing business as Acute PMC, including conversation-start interventions and Focused Project Reviews. By purchasing a service, you agree to these Terms and the posted Refund and Cancellation Policy.
Purchases made under a prior version of these Terms remain governed by the version in effect at that purchase unless the parties agree otherwise in writing.
Services
Acute PMC offers professional project-consulting services. Posted scope on the applicable public page and the purchase confirmation control what is included. Additional work requires a separate written agreement. Each purchased engagement covers one clearly identified initiative unless the confirmation says otherwise.

Focused Project Reviews
Bounded professional services you can buy when posted. Not Diagnose, Stabilize, or Lead Recovery. Not formal independent assurance, audit, or attestation.

Fees and payment
Fees for checkout SKUs are due at purchase through Stripe. Payment does not create an open-ended retainer or an obligation to perform work outside the purchased scope. Conversation-start interventions have no public checkout unless one is expressly posted.

Focused Project Reviews: the delivery clock starts only after payment plus complete accepted intake. Incomplete, unreadable, unsupported, over-scope, or prohibited materials mean the clock has not started. “Accepted intake” means Acute confirms a compliant upload or form by email. Accepting intake starts the delivery clock; it does not by itself make a Focused Project Review irrevocably nonrefundable — refund eligibility is governed by the Refund and Cancellation Policy. For the currently posted Status Readout Review, “typically within 5 business days” is operational timing, not a contractual SLA, emergency promise, or 24×7 commitment.
Other Focused Project Review products are not currently offered through public checkout unless a specific product page is posted and enabled.
Client responsibilities
Optional clarification / debrief calls included in a SKU must be scheduled within the window stated on that SKU page; they do not extend the written deliverable. You remain responsible for project decisions, approvals, execution, stakeholder communication, legal compliance, security, and results. You must provide accurate information, ensure participants are authorized, and submit only material you have authority to disclose. You must not upload PHI, credentials/secrets, repositories, or other prohibited materials described in the Privacy Policy and on the SKU page.
Nature of guidance
Acute PMC provides project and program consulting judgment based on the information available during the engagement. Focused Project Reviews are outside, evidence-led professional services, not independent assurance, audit, or attestation, and not a substitute for your counsel, auditor, or implementer.
Guidance is not legal, tax, accounting, investment, cybersecurity, engineering, medical, or other regulated professional advice. Acute PMC does not guarantee a particular project, financial, organizational, operational, approval, schedule, cost, or recovery outcome. A later conversation about Clarity, Rescue, or Recovery is never automatic.
Confidentiality and sensitive information
Guidance is not legal, tax, accounting, investment, cybersecurity, engineering, medical, or other regulated professional advice. Acute PMC does not guarantee a particular project, financial, organizational, operational, approval, schedule, cost, or recovery outcome. A later conversation about Clarity, Rescue, or Recovery is never automatic.Confidentiality and sensitive informationAcute PMC will use nonpublic client information reasonably necessary for service delivery only for that purpose, and will limit access to Andrew Davenport or a reviewer he designates in writing, plus necessary approved providers. This commitment does not apply to information that becomes public without breach, was already lawfully known, is lawfully received from another source, is independently developed, or must be disclosed by law.
Deliverables and use
Do not submit information you lack authority to disclose, passwords or authentication secrets, API keys, tokens, private keys, .env files, complete payment-card information, classified information, full repositories or ticket dumps as primary input, or PHI or similarly regulated sensitive information unless Acute PMC separately approves an appropriate written handling arrangement. If prohibited material appears, Acute may stop work, delete copies, notify you, and refund or re-scope.Uploads are not used for marketing or case studies without separate written consent.Deliverables and useThe client retains ownership of client-submitted material. The purchasing client may use and distribute the final client-specific deliverable internally within its organization for legitimate business purposes. Acute PMC retains ownership of its pre-existing methods, frameworks, templates, diagnostic structures, question sets, general know-how, and reusable non-client-specific intellectual property. Neither party may publicly publish the other party’s confidential material without appropriate written permission.Third-party services, files, and retention
Third-party services, files, and retention
Payment, intake, scheduling, email, hosting, or approved file handling may be provided by third-party services; their terms and privacy practices apply to their systems. Acute PMC is not a document-storage or records-management service. Clients are responsible for retaining their own source materials and delivered work product.Working copies of submitted project files are retained only as needed to deliver the SKU and for 30 days after fulfillment or refund, then deleted from Acute-controlled working storage. You may request earlier deletion after delivery; Acute will confirm in writing. There is no promise of certified destruction beyond standard delete from Acute-controlled storage. Stripe/payment records are retained per Stripe and legal requirements (not the same as file retention). Provider backups may persist according to provider capabilities.Refunds and cancellationsRefunds, rescheduling, cancellations, no-shows, client lateness, declines, and an Acute PMC cancellation are governed by the Refund and Cancellation Policy posted on this website.Limitation and allocation of responsibility
Refunds and cancellations
To the extent permitted by law, services and deliverables are provided without a warranty of a particular result. Acute PMC’s aggregate liability arising from an engagement will not exceed the fees actually paid for that engagement. Acute PMC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost profits, lost revenue, or lost opportunity. The client is responsible for claims arising from material it was not authorized to provide or instructions that violate law or third-party rights. Before beginning a formal dispute, the parties will attempt good-faith informal resolution. These Terms and related disputes are governed by Idaho law, without regard to conflict-of-law rules. Nothing in this section limits liability that cannot lawfully be limited. The Refund and Cancellation Policy controls refunds and scheduling.ChangesAcute PMC may update these Terms for future purchases.
